Terms and Conditions

the EBRK UG

1. Scope

  1. These General Terms and Conditions (GTC) apply to all contracts, deliveries and services between [Name of the company] (hereinafter "Provider") and the customer, unless expressly agreed otherwise in writing.

  2. Deviating terms and conditions of the customer shall not apply unless the provider expressly agrees to their validity in writing.

2. Subject matter of the contract

  1. The provider provides services and delivers software according to individual agreements or product descriptions.

  2. Unless expressly agreed, no source code will be delivered.

3. Scope of services

  1. The scope of functions of the software is determined from the product description or written agreement valid at the time the contract is concluded.

  2. Installation, training or adaptation services are only owed if they have been separately agreed in writing.

4. Rights of use

  1. The customer receives a simple, non-exclusive, non-transferable right to use the software.

  2. The reproduction, distribution, public accessibility or processing of the software is prohibited without the written consent of the provider.

  3. The right of use is valid for an unlimited period of time unless a different arrangement (e.g. rental/subscription model) has been agreed.

5. Prices and payment

  1. All prices are exclusive of statutory VAT, unless gross prices are expressly stated.

  2. Payments are due without deduction within 14 days of invoicing.

  3. The provider is entitled to withhold services until full payment has been made.

6. Warranty

  1. The Provider warrants that the Software will function substantially in accordance with the agreed specifications for a period of three (3) months from delivery.

  2. The warranty is limited to repair or replacement.

  3. Further warranty rights, in particular withdrawal, reduction or compensation, are excluded to the extent permitted by law.

  4. No warranty is provided for defects caused by improper use, modifications or interventions by third parties.

7. Updates and Support

  1. The Provider will provide one (1) update free of charge within twelve (12) months of delivery.

  2. Any additional updates, upgrades or support services require a separate agreement.

8. Liability

  1. The provider’s liability – regardless of the legal basis – is limited to intent and gross negligence.

  2. In the case of slight negligence, the provider is only liable for breaches of essential contractual obligations (cardinal obligations) and only for foreseeable, contract-typical damages.

  3. The maximum liability amount is ten times the purchase price paid by the customer.

  4. Liability for lost profits, loss of data, indirect damages and consequential damages is excluded to the extent permitted by law.

  5. Liability under the Product Liability Act and in the event of injury to life, body or health remains unaffected.

9. Final provisions

  1. Changes and additions to these Terms and Conditions must be made in writing.

  2. Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

  3. German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.

  4. The place of jurisdiction is the registered office of the provider if the customer is a merchant, a legal entity under public law or a special fund under public law.

EBRK UG is responsible for the collection, processing and use of personal data within the scope of the care software.


2. Purpose of data processing
The nursing software is used to manage and document nursing services. In particular, the following data is processed:

  • Patient master data (name, address, date of birth, contact details)

  • Health and care data (diagnoses, medication plans, care reports)

  • Billing data (health insurance, proof of benefits)

  • Employee data for duty scheduling and deployment documentation

Processing is carried out exclusively to fulfill legal and contractual obligations in care.

3. Legal basis
The processing of personal data is based on the GDPR, in particular:

  • Art. 6 (1) (b) GDPR (performance of contract)

  • Art. 6 (1) (c) GDPR (legal obligation)

  • Art. 9 (2) (h) GDPR (health data in the context of care)

4. Data storage and security

  • Storage takes place exclusively on servers in Germany.

  • Access is only possible via encrypted connections (TLS/SSL).

  • Databases are protected by multi-level access controls.

  • Regular backups and emergency plans are implemented.

  • Employees are obliged to maintain confidentiality and data protection.

5. Access control

  • Only authorized persons (e.g. nurses, doctors, administrative staff) have access.

  • Access rights are granted according to the need-to-know principle.

  • Logging of all access to sensitive data.

6. Sharing of data
Data will only be passed on if necessary:

  • to health insurance companies and billing offices

  • to treating physicians or therapists (as part of the care)

  • to authorities, as required by law

No disclosure to third parties for advertising or analysis purposes.

7. Storage period
Personal data will only be stored for as long as required by law or as necessary to fulfill the purpose. After that, it will be deleted or anonymized.

8. Rights of data subjects
Data subjects have the right to:

  • Information (Art. 15 GDPR)

  • Correction (Art. 16 GDPR)

  • Deletion (Art. 17 GDPR)

  • Restriction of processing (Art. 18 GDPR)

  • Data portability (Art. 20 GDPR)

  • Objection (Art. 21 GDPR)

Inquiries can be directed to the responsible body at any time.

If required by law, an external or internal data protection officer will be appointed.

10. Changes
EBRK UG reserves the right to change these guidelines as necessary to comply with legal requirements or technical developments.

Service Level Agreement (SLA)

Kunde/Nutzer:
Jede natürliche oder juristische Person, die die Pflege-App über den App Store herunterlädt und nutzt.

2. Vertragsgegenstand

Dieses SLA beschreibt die Serviceleistungen, Verfügbarkeiten und Supportleistungen für die Pflege-App („App“), die von der EBRK UG bereitgestellt wird.


Die App dient der digitalen Unterstützung von Pflegeeinrichtungen, Pflegediensten und Angehörigen im Bereich Dokumentation, Verwaltung und Kommunikation.

3. Verfügbarkeit der App

  • Die App ist grundsätzlich 24/7 verfügbar, vorbehaltlich Wartungsfenstern und technischer Einschränkungen.

  • Die angestrebte monatliche Verfügbarkeit liegt bei ≥ 99 %.

  • Wartungsarbeiten werden – soweit möglich – außerhalb der üblichen Geschäftszeiten durchgeführt und im Vorfeld angekündigt.

  • Nichtverfügbarkeiten aufgrund von Apple App Store-Ausfällen, Internetprovider-Störungen oder höherer Gewalt sind ausgenommen.

4. Wartung & Updates

  • Regelmäßige Updates werden zur Fehlerbehebung, Funktionsverbesserung und Sicherheit veröffentlicht.

  • Updates erfolgen über den Apple App Store.

  • Nutzer sind verpflichtet, die jeweils aktuelle Version der App zu verwenden.

5. Supportleistungen

  • Supportzeiten: Montag bis Freitag von 09:00 bis 17:00 Uhr (CET), ausgenommen gesetzliche Feiertage in NRW.

  • Kontaktmöglichkeiten:

    • E-Mail: [Support-Adresse einsetzen]

    • Ticket-System (falls vorhanden)

  • Reaktionszeiten:

    • Kritische Fehler (z. B. App nicht nutzbar): Reaktion innerhalb von 8 Stunden

    • Normale Fehler (Einschränkungen, Workarounds möglich): innerhalb von 24 Stunden

    • Allgemeine Anfragen: innerhalb von 2 Werktagen

6. Datensicherheit & Datenschutz

  • Die Datenverarbeitung erfolgt ausschließlich in Deutschland und gemäß DSGVO.

  • Es gelten die in der Datenschutzerklärung und den Technisch-Organisatorischen Maßnahmen (TOMs) beschriebenen Vorgaben.

  • Die EBRK UG verpflichtet sich, Sicherheitsvorfälle unverzüglich zu melden.

7. Pflichten des Nutzers

  • Der Nutzer ist verpflichtet:

    • Zugangsdaten sicher zu verwahren

    • Updates zeitnah einzuspielen

    • Keine rechtswidrigen Inhalte einzustellen oder die App missbräuchlich zu nutzen

8. Haftung & Haftungsbeschränkung

  • Die EBRK UG haftet im Rahmen der gesetzlichen Bestimmungen, jedoch nicht für Ausfälle außerhalb des eigenen Einflussbereichs (App Store, Internetprovider, höhere Gewalt).

  • Für leichte Fahrlässigkeit wird die Haftung auf wesentliche Vertragspflichten und den vorhersehbaren Schaden begrenzt.

9. Vertragslaufzeit & Kündigung

  • Dieses SLA gilt solange der Nutzer die App verwendet.

  • Das Vertragsverhältnis kann vom Nutzer jederzeit durch Deinstallation der App beendet werden.

  • Der Anbieter behält sich vor, die App mit angemessener Frist einzustellen.

10. Änderungen des SLA

  • Änderungen dieses SLA werden auf der Website der EBRK UG veröffentlicht.

  • Nutzer werden über wesentliche Änderungen in der App oder per E-Mail informiert.

11. Gerichtsstand & anwendbares Recht

  • Es gilt deutsches Recht.

  • Gerichtsstand ist der Sitz der EBRK UG, soweit rechtlich zulässig.
